Sandra Garza, the longtime partner of Capitol Police Officer Brian Sicknick, 42, argued in her lawsuit filed Thursday (January 5) in the District Court for the District of Columbia that Trump, 76, along with Julian Khater, (33) ) and George Tanios (40) are 'directly and indirectly liable' for the death of their former friend.
The lawsuit, filed the day before the second anniversary of the riot, said: 'As a direct result of the attack by defendants Khater and Tanios and others -- instigated by defendant Trump -- Officer Sicknick suffered physical injuries. The following day, January 7, 2021, Officer Sicknick tragically died. Everything that happened on January 6 - including the actions of defendants Trump, Khater and Tanios - played a significant role in the medical condition that led to Officer Sicknick's death the next day.”
Khater pleaded guilty in September to attacking three police officers, including Brian, with a chemical spray during the Capitol riots. Tanios, who reportedly passed the substance to Khater, received a plea bargain in July on charges related to the January 6 attack.
Brian suffered two strokes and eventually died. Sandra's lawsuit seeks $30 million in damages from Trump, Khater and Tanios. Sandra also accused the trio of conspiring to block official certification of the 2020 election, as well as assault or abetting the assault and rioting or inciting a riot. The Washington coroner ruled that Brian's death was the result of multiple strokes that occurred hours after the riot, and prosecutors avoided connecting his death to the attack. But the coroner admitted that 'everything that happened played a role in his condition,' while Capitol Police consider his death a 'death on the job.'
